Registration and Bidding:
By registering for the Shadows Ignited Auction I understand Silent No Longer Tennessee, it’s employees and agents, henceforth known as the Seller, provide no warranty or guarantee of the items listed in this auction. Furthermore, I agree and acknowledge that the Seller provides no warranties, including any implied warranties of item fitness and that Seller does not guarantee items will meet any specific purpose or standard. Seller is not liable for any errors or the correctness of information provided in this package or in any advertisements or materials disseminated pertaining to the items(s). All information contained in the item description and any advertisements was obtained from donating business and believed to be accurate. However, NO warranty or guarantee is expressed or implied. If you have questions about or issues with the item purchased, you will need to contact the business who supplied the item. Not withstanding any other provision herein, bidder agrees to hold Seller harmless from and to indemnify Seller against any and all claims, demands or lawsuits by any third party for injuries, damages, losses or other harm arising from or relating to the provision or use of products sold under this Agreement. Furthermore I agree to defend Seller against any and all such claims, demands or lawsuits and shall bear the cost of such defense, including attorney’s fees.
Liability:
Descriptions, photos and any other information given are solely for informational purposes. Bidders are responsible for conducting their own research prior to bidding. Bidder acknowledge that all property purchased is on an "as-is" basis, and that bidder is responsible for all costs and expenses of removal of any property purchased at auction.The bidder hereby assumes full responsibility for the risk of bodily injury, to the bidder or the bidder agents and employees, of property damage to any property purchased by the bidder and/or subsequent removal by any party for any such property.
The bidder hereby commits to remove purchased property from the premises during the designated removal periods, or agrees to notify Seller via at contact@silentnolongertn.org within seventy-two (72) hours of the auction closing and notify Seller they want the items shipped at bidder's expense Failure to pick up the item or make shipping arrangements within the time frame indicated will result in forfeiture of the items with NO REFUND PROVIDED.
Charge Back:
Bidder understands and agrees that any attempt to obtain a chargeback on an item purchased by the Bidder may result in criminal and/or civil legal proceeding against Bidder. Bidder will be responsible for all legal expenses and court costs for themselves and the Seller.
Refunds
By placing a bid, you agree to hold Silent No Longer Tennessee and its agents harmless of any wrong doing, agree that we are unable to guarantee the authenticity or any item, an item’s working ability or that an item is free of any defect. All items are sold in an as-is condition and there will be no refunds, chargebacks, or credit issued for items after auction has ended. ALL SALE ARE FINAL.
Misc. Terms:
Bidder hereby releases, indemnifies, and holds harmless Silent No Longer Tennessee, their agents and employees (collectively, the "Releases"), from any and all injury, loss, liability, damage or cost the bidder may incur, whether to the bidder personally, to the bidder's agents and employees, or to any items purchased by the bidder, arising out of the bidders purchase and removal of equipment, whether such injury, loss, liability, damage or cost may have been caused by the negligence of the Releases, or not. Bidder expressly agrees that the terms and conditions of this release and waiver, understands it is intended to be broad and inclusive, and shall have full legal force and effect.
