Waiver
In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all right and claims for damages or injuries that I may have against the Lake Travis Education Foundation (LTEF), the Event Director, and/or The Hills Country Club, if that is where I choose to participate and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.
I know that running/walking in a road race is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with running in this event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims which I might have based on any of those and other risks typically found in running a road race. I acknowledge all such risks are known and understood by me. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event.
I understand that this is a virtual race and that I am running and participating in an area of my choosing. LTEF and/or the Club (if participating in the Hills) shall not be responsible for any injury sustained and makes no representation of the safety of the area in which I have chosen to run.
Release and Indemnity.
In exchange for the LTEF and Club allowing me to participate in the Activity for this virtual race, I, on my own behalf and on behalf of my family members, heirs beneficiaries, assigns and all parties claiming by, through or under me, do hereby RELEASE, INDEMNIFY AND HOLD HARMLESS the Club, its parent, affiliated and subsidiary companies as well as all of their respective officers, directors, agents, contractors, employees, heirs, successors, assigns, volunteers and guests from all liability for any injury, death, loss or damage connected in any way whatsoever to participation in the Activity, including that which may result, directly or indirectly, in whole or in part, from the negligence or willful misconduct of the Club or any third party, or from the design of the Club’s facilities.
Medical.
If I am injured while participating at the Hills Country Club, I give consent to emergency medical care and transportation in order to obtain treatment in the event of injury, as the Club may deem appropriate, and I agree to accept full responsibility for the payment of all costs for same. The release, indemnity and hold harmless provisions set forth hereinabove extend to any damage or loss arising out of the medical treatment and transportation provided in the event of an emergency, including the negligent acts or omissions of any health care providers, their agents, employees or representatives.
Property Loss.
All personal property brought to the Activity is brought at my sole risk as to its theft, damage or loss.
By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver.
Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, video graphic or electronic recording of this event for legitimate purposes.
Severability.
Any provision or portion of this Agreement found to be invalid by the courts having jurisdiction shall be invalid only with respect to such provision or portion. The remaining provisions or portion hereof, shall be construed and enforced to the same effect as if such offending provision or portion thereof had not been contained herein.
